The Applicant’s claim for asylum was rejected last October on credibility grounds due to a lack of documentation of her claim.
Since the refusal of her refugee claim, Ms. Derakhshandeh Tosarv”s
lawyer has submitted documented evidence demonstrating that she faces
adultery charges in Iran. She has received two summons to appear before
the court in Iran to face the charges. She has also received new
evidence that her estranged husband has been harassing her elderly
father, accusing him of hiding her, and threatening to kill both her and
her father, thus corroborating the fear of her husband’s violence
preventing her from testifying to the immigration authorities in her
first hearing. Under the new immigration law, all refugee claimants are now banned from applying for a PRRA ( pre removal risk assessment) and Sara (Fatemeh) falls short of this date by 2 weeks. |

Ms. Derakhshandeh Tosarv’s lawyer is requesting a deferral of their
removal until after October 5, 2012 so that the new evidence which
establishes her fears for returning to Iran can be assessed under a
pre-removal risk assessment (PRRA).
Most Canadians are shocked at hearing that Sara (Fatemeh) is about
to be set to Iran to face a grave punishment. “ The fact that a
removal officer can blithely tell me that he can not wait to allow a
risk assessment to be conducted based on the new evidence shows just
how far CBSA has drifted from Canadian values “ Winter-Card her
lawyer says.
Other lawyers have cited cases where they have had removal deferred
after they threatened to launch a charter challenge.
